Founders Form AI, Inc. (“Founders Form,” “we,” “us,” or “our”) respects privacy and is committed to protecting personal information entrusted to us. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information in connection with the Founders Form website and the Founders Form operating system and platform (collectively, the “Founders Form OS” or the “Services”).
This Privacy Policy applies to registered users of the Founders Form OS and to individuals who act on behalf of companies that use the Services. It does not apply to legal services provided by Founders Form, PC, which are governed exclusively by a separate written engagement letter.
1. Scope and Applicability
This Privacy Policy applies to personal information collected through the Founders Form website and through use of the Founders Form OS, including AI-assisted workflows, document execution features, and related tools. It describes our information practices in both online and platform contexts.
This Privacy Policy does not create an attorney-client relationship. Any legal confidentiality obligations, professional duties, or attorney-client privileges arise only if and when a company executes a valid engagement letter with Founders Form, PC.
2. Who This Policy Applies To
Founders Form provides Services to companies, but in doing so we necessarily collect and process personal information relating to individuals who act on behalf of those companies. These individuals may include chief executive officers, officers, directors, authorized users, signatories, investors, counterparties, and other individuals whose information is submitted to or processed through the Services.
Although the company is our customer, this Privacy Policy governs how we handle personal information relating to identifiable individuals associated with that company.
3. Age Restrictions
The Services are intended solely for business use and are not designed for or directed to anyone under 18 years of age. We do not knowingly collect personal information from minors. If we become aware that personal information has been collected from a minor, we will take appropriate steps to delete that information.
4. Information We Collect
We collect several categories of personal information depending on how the Services are used.
We may collect authorized user information, such as names, titles, company affiliations, email addresses, contact details, authentication credentials, and account identifiers. We also collect company-related information, including company names, formation details, governance records, equity data, and other corporate metadata submitted in connection with OS workflows.
Companies using the Services may upload documents and content, including organizational documents, contracts, transaction materials, equity records, and related files. We also collect technical and usage information, such as log data, IP addresses, device and browser information, usage metrics, audit logs, and security-related records. Finally, we collect communications, including messages sent through the Founders Form OS and emails or other communications exchanged with us.
How We Collect Information
We collect personal information in several ways. Information is collected directly from users when accounts are created, workflows are executed, documents are uploaded, or communications are sent to us. Information is also collected automatically when users access or use the Services, including through system logs, usage analytics, cookies, and similar technologies. In addition, we may receive information from service providers that act on our behalf, such as hosting providers, authentication services, analytics providers, payment processors, and e-signature vendors.
5. How We Use Information
We use personal information for legitimate business purposes consistent with operating and improving the Services. These purposes include providing, maintaining, and securing the Founders Form OS; executing workflows and generating AI-assisted outputs; authenticating users; monitoring usage and preventing misuse; improving platform performance and functionality; communicating with users about the Services; and complying with legal, regulatory, and contractual obligations.
Attorney Assistance
If a company elects to upgrade to attorney assistance and executes a valid engagement letter, relevant information may be shared with Founders Form, PC solely for the purpose of providing legal services under that engagement. No information is shared with Founders Form, PC for legal services unless and until a signed engagement letter is in place.
6. AI-Assisted Tools
The Founders Form OS includes AI-assisted execution tools designed to support workflow automation and document generation. AI outputs are generated based on user inputs, selections, and configurations. We do not use customer data to train general-purpose AI models.
When attorney assistance is enabled, certain AI-generated outputs may be reviewed by humans. AI outputs do not constitute legal advice and may be incomplete, inaccurate, or require human review before use.
7. Cookies and Similar Technologies
We use cookies and similar technologies to operate, secure, and improve the Services. These technologies may include session cookies that expire when a browser is closed, persistent cookies that remain on a device for a defined period, functional cookies necessary for authentication and core features, and analytics or error-monitoring tools that help us understand usage patterns and diagnose technical issues.
We do not use cookies or tracking technologies for advertising or cross-context behavioral tracking. Users may control cookies through browser settings, though disabling cookies may affect certain features of the Services.
8. Aggregated and Anonymized Data
We may create aggregated or anonymized data derived from personal information. Such data does not identify individuals or companies and may be used for analytics, benchmarking, research, and product improvement. Where data cannot reasonably be used to identify any person or company, we may use or disclose it without restriction.
9. Confidentiality and Ownership
Companies retain ownership of all documents and data they upload to the Services. Uploaded materials are treated as confidential and are processed solely to provide and support the Services.
Confidentiality under this Privacy Policy is distinct from attorney-client privilege. Attorney-client privilege applies only pursuant to a valid engagement letter with Founders Form, PC.
10. Sharing and Disclosure of Information
We may disclose personal information to service providers that support our operations, such as cloud hosting, security, analytics, payments, and e-signature providers, subject to appropriate contractual safeguards. We may also disclose information to Founders Form, PC when attorney assistance is activated and governed by an engagement letter.
In addition, we may disclose personal information as required by law, in response to lawful requests, to protect the rights, property, or safety of Founders Form or others (including for fraud prevention and security investigations), or in connection with corporate transactions such as financings, mergers, acquisitions, or asset transfers.
We do not sell personal information, do not share personal information for cross-context behavioral advertising, and do not operate as a data broker.
11. Third-Party Links and Services
The Services may include links to third-party websites or integrations with third-party services. The privacy practices of those third parties are governed by their own policies, and we are not responsible for their practices.
12. Choices and Controls
Users may update certain account and profile information through the Services or by contacting us. Where applicable, users may opt out of non-essential communications using unsubscribe mechanisms or by contacting us. Users may also control cookies through browser settings.
Certain communications are transactional or service-related and are necessary to provide the Services.
13. Data Retention
We retain personal information while an account remains active and thereafter for a limited period as necessary for legal, regulatory, security, or legitimate business purposes. Deletion requests are honored subject to applicable legal obligations.
14. Security
We maintain administrative, technical, and organizational safeguards designed to protect personal information. Our security program is SOC 2-aligned. However, no system can be guaranteed to be completely secure, and we do not provide absolute security guarantees.
15. Your Privacy Rights (U.S. Users)
California residents have rights under the California Consumer Privacy Act and California Privacy Rights Act, including rights to access, correct, delete, and limit certain uses of personal information, and the right not to be discriminated against for exercising those rights.
As a matter of policy, we extend substantially similar rights to all U.S. users, subject to verification. Requests may be submitted to privacy@foundersform.com, and we will respond within the timeframes permitted by law.
16. U.S.-Only Services
The Services are intended for U.S. users only. Personal information is processed and stored in the United States.
17. Changes to This Privacy Policy
We may update this Privacy Policy from time to time. When we do, we will update the “Last Updated” date at the top of the policy. Continued use of the Services after an update constitutes acceptance of the revised Privacy Policy.
